Joint tenancy refers to yourself and another party, or parties, owning the stake inland, a business premises or just general property. There may come a time when you need to remove yourself or others from the tenancy. Sometimes these are for good reasons, but sadly, they are more likely due to divorce or death. For example, upon the death of a spouse or civil partner, the ownership should move to a sole tenancy. The solicitor has to ensure this runs smoothly.

A recent case in 2020 has put this process under the spotlight as being challenging to get through. The case was around simply delivering a recorded piece of post requesting a severance. Courts have ruled that it was not, and as a result, the law surrounding the severance of joint tenancy has been called into question. You cannot slip up with the process, so the Solicitors must be on board with your wishes.
